Terms of Service

The terms of this agreement (“Terms of Service” or “Terms”) govern the relationship between you and Akari Labs Ltd (hereinafter “the Company”, “we”, “us”, or “our”) regarding your use of the Backgammon Masters game, the websites mastersofbackgammon.net, mastersofbackgammon.ru, backgammonmasters.net, 2kbgames.com, and all related services (collectively, the “Service”).
Use of the Service is also governed by our Privacy policy and Code of Conduct, which are incorporated herein by reference.
BY INSTALLING, USING, OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, USE, OR ACCESS THE SERVICE.
The Company reserves the right to change, modify, add, or remove provisions of these Terms at any time by posting the amended version on the Service or the website. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to any changes, you must stop using the Service immediately.
1. Right to Use the Service
1.1 License
Subject to your agreement and continuing compliance with these Terms and any other relevant Company policies, you are granted a non-exclusive, non-transferable, revocable, and limited right to access and use the Service solely for your own personal, non-commercial entertainment purposes.
1.2 Restrictions
You agree that you will not, under any circumstances:
• Purchase, sell, rent, transfer, or exchange your account or any account data to any other person.
• Create an account using false information or on behalf of another person.
• Use the Service if you have previously been banned by the Company.
• Use, develop, or distribute cheats, exploits, bots, mods, or any unauthorized third-party software designed to modify or interfere with the Service.
• Disrupt the normal flow of the Service, including manipulation of Elo ratings, match fixing, rigging results, or exploiting bugs to gain an unfair advantage.
• Carry out attacks on the Service, including distribution of viruses, DDoS attacks, or other attempts to disrupt its operation.
• Gain unauthorized access to the Service, other users’ accounts, or connected servers.
• Reverse engineer, decompile, or disassemble the Service’s software.
• Use the Service for advertising, spam, or distribution of commercial messages.
• Use the Service for gambling, betting, or any activity involving the winning of real money.
2. Account Registration and Security
Certain features of the Service may require you to create an account. Registration is available via email, Google account, Apple ID, Facebook, or other supported authentication methods. You are responsible for maintaining the security of your login credentials and for all activities that occur under your account.
Each player may register only one account per platform. Using multiple accounts may result in the suspension of all associated accounts.
The Company reserves the right to remove or change any username at any time. You must immediately notify the Company of any unauthorized use of your account.
3. Virtual Items and In-App Purchases
3.1 Virtual Currency and Items
The Service may include virtual currency (such as coins or gold) and virtual items (collectively, “Virtual Items”). Virtual Items may be purchased with real money or earned through gameplay. Virtual Items have no real-world monetary value and cannot be exchanged for real money, goods, or services.
3.2 License, Not Ownership
When you acquire Virtual Items, you receive a limited, non-transferable, revocable license to use them within the Service. You do not own Virtual Items and have no property rights in them. The Company may manage, regulate, modify, or remove Virtual Items at any time without notice.
3.3 Purchases
All purchases of Virtual Items are final and non-refundable, except as required by applicable law. Purchases are processed through third-party payment platforms (Apple App Store, Google Play Store, Xsolla) and are subject to their respective terms and conditions.
3.4 Prohibited Transactions
Selling, transferring, or otherwise making available Virtual Items, accounts, or account data to other persons for real money or any other form of compensation is strictly prohibited and constitutes a material breach of these Terms.
4. User Content
“User Content” refers to any messages, images, text, avatars, usernames, and other materials that you upload or transmit through the Service, including chat messages and private messages.
You are solely responsible for your User Content. By submitting User Content, you grant the Company a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, and distribute such content in connection with the Service.
The Company has the right, but not the obligation, to moderate, edit, or remove any User Content at its sole discretion without notice.
5. Code of Conduct
Your use of the Service is governed by the Code of Conduct, which is published within the Service and forms an integral part of these Terms. Violations of the Code of Conduct may result in chat muting, temporary suspension, or permanent banning of your account.
The Company reserves the right to determine what conduct violates the spirit or letter of the Code of Conduct or these Terms, and to take appropriate action, including account deletion.
6. Intellectual Property
The Service, including all content, functionality, software, graphics, design, text, images, and audio, is the property of the Company and is protected by international copyright, trademark, and other intellectual property laws.
Your use of the Service does not grant you any ownership or intellectual property rights in the Service or its content.
7. Third-Party Services and Advertising
The Service may contain links to or integrations with third-party services, including payment systems, advertising networks, analytics services, and social networks (Google, Facebook, Apple). Your interactions with third-party services are governed by their own terms and privacy policies.
The Service may display advertisements from third-party advertising networks. These networks may use cookies, device identifiers, and similar technologies. You may opt out of personalized advertising through your device settings.
The Company is not responsible for the content, accuracy, or availability of third-party services or advertisements.
8. Termination
8.1 Termination by the Company
The Company may limit, suspend, delete, or block your account or access to the Service, with or without notice, if you violate these Terms or there are grounds to believe that you are in violation.
As a result of account termination, you may lose your username, Virtual Items, game progress, and other data. The Company is under no obligation to compensate you for such losses. The Company reserves the right to delete any account that has been inactive for 365 days.
8.2 Termination by You
You may delete your account at any time by contacting us. Upon deletion, your right to use the Service will cease. No refunds will be provided for Virtual Items or any other purchases.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR VIRTUAL ITEMS.
THE COMPANY’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY IN THE 12 MONTHS PRECEDING THE EVENT, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, agents, and suppliers from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or the rights of any third party.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus.
12.2 Dispute Resolution
Any dispute arising out of or in connection with these Terms shall be resolved by the competent courts of the Republic of Cyprus. The parties agree to first attempt to resolve any dispute through good-faith negotiation by contacting the Company.
13. Changes to the Service
The Company reserves the right to modify, update, suspend, or discontinue the Service, or any part thereof, at any time. The Company shall not be liable for any modification, suspension, or discontinuation of the Service. The Company may also modify game parameters (including Virtual Item values, game mechanics, and features) at any time.
14. General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy policy and Code of Conduct, constitute the entire agreement between you and the Company and supersede all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be invalid, this shall not affect the validity of the remaining provisions.
14.3 Waiver
The failure of the Company to exercise any right shall not constitute a waiver of that right.
14.4 Assignment
The Company may assign these Terms in whole or in part without restriction. You may not assign your rights and obligations without the Company’s written consent.
14.5 Force Majeure
The Company shall not be liable for delays or inability to perform its obligations due to force majeure events, including natural disasters, military actions, epidemics, power outages, or internet failures.
